OAKLAND — A local caretaker had been accused of not just repeatedly raping a woman he was supposed to be looking after, but having her kiss people on camera for money and of fathering her unborn child.

In the end, the case came down to a simple paternity test. But when DNA evidence proved the defendant wasn’t the father, Alameda County prosecutors made a complete about-face, dismissing serious felony charges they’d filed only weeks before, court records show.

The man faced decades in prison. He was charged with pimping and pandering, forcible sodomy, forcible rape and forcible oral copulation, based on the word of the woman he was caretaking for. Court records say the woman, who suffers from psychosis and borderline personality disorder, told authorities he raped her repeatedly over the course of a year and, “because of what he did, I winded (sic) up with a baby now.”

This news organization is not listing the subjects’ names, ages, or location of the alleged crimes to protect their confidentiality now that the case has fallen apart.

The man bailed out of jail, but was obviously unable to continue working while the case was pending. Prosecutors filed the charges on Dec. 18. Almost exactly two months later, the DNA test came back proving he wasn’t the father, according to court filings.

After the test came back, prosecutors dropped the case due to “insufficient evidence,” according to court records. The defendant was set to have a preliminary hearing that week. His attorney said in a brief interview that they were “happy justice is done.”
