Man charged in suspected Livermore road-rage shooting

LIVERMORE — A 26-year-old Oakley man has been arrested and charged in a road-rage related shooting last month that left a man he apparently did not know wounded, according to authorities and court records.

The suspect, Demarionte Smith, was arrested April 1 in Seattle, Wash. by the U.S. Marshals Pacific Northwest Violent Offender Task Force.

He has been charged with attempted murder, assault with a semi-automatic firearm and assault with a firearm, as well as numerous sentencing enhancements. As of Wednesday morning, he had not yet been extradited from Washington where he is being held without bail.

The shooting happened just before 5 p.m. March 11 near North Vasco Road and Dalton Avenue. North Vasco Road is the beginning of a rural two-lane road in Livermore that connects Alameda and Contra Costa counties.

Officers arrived on scene and found a man suffering from at least one gunshot wound. The victim was transported to the hospital but has since been released. The roadway was closed for several hours as officers processed the scene and collected evidence.

Police believe the shooting stemmed from a road-rage incident but did not provide exact details. Police said both men, who apparently did not know each other, were outside their vehicles when the shooting happened. According to court records, after the wounded man fell to the pavement, Smith allegedly fired some more shots at him, but police did not say if any struck him.

Police were able to identify Smith as the suspect from video of the shooting provided by witnesses.

Police determined Smith had fled to Seattle after the shooting to stay with family members and alerted the task force.
