San Jose chiropractor pleads guilty to underreporting $1.4 million in income for taxes

A San Jose chiropractor pleaded guilty Wednesday to assisting in the false preparation of a tax return for underreporting the earnings of his chiropractic practice in 2019, according to the U.S. Attorney for the Northern District of California.

Tae Hyun Lee, a 62-year-old resident of San Jose, took a plea deal admitting his guilt to one count of aiding and assisting in the preparation of a false tax return for hiding income generated by his business Gentle Chiropractic Care from the person preparing his tax return and the Internal Revenue Service, prosecutors said in a news release.

From 2018 to 2020, Lee did not deposit more than $1.4 million worth of checks into his practice’s bank account and instead cashed them at a check-cashing business, prosecutors said. He also deposited electronic payments and checks into his personal bank account.

Lee told the individual who prepared his tax forms that all the money generated by his business had been deposited into its account, leading the preparer to report it on the forms, prosecutors said. This resulted in the majority of the practice’s income going unreported to the IRS.

The unreported income resulted in a loss of at least $439,028 to the IRS in taxes, prosecutors added.

Lee is self-employed, and he is the only owner of Gentle Chiropractic Care, prosecutors said.

Lee is scheduled to be sentenced Sept. 24 by U.S. District Judge P. Casey Pitts. He could serve up to three years in prison.
