OAKLAND — A man who allegedly fatally shot another man who he was trying to get to leave his family’s North Oakland home last week has been charged with murder, according to authorities and court documents.

John Cvar, 72, was charged Tuesday in the fatal Aug. 9 shooting of Aknico Heidengren, 33, a transient, authorities said.

The shooting happened about 2 p.m. inside a home in the 500 block of Aileen Street that had been owned for decades by the Cvar family, authorities said.

Cvar’s youngest brother was living there; because of health issues, Cvar and another brother routinely checked on him, authorities said.

On Friday, Heidengren was discovered living at the home by the other brother and was asked to leave, but was apparently hesitant to do so. Police were called but were cancelled when Heidengren did leave.

It was not clear if he had been allowed to stay by the Cvar brother living there, who apparently had allowed others to do so, authorities said.

But Heidengren returned later after the brother had left and was there again Saturday when Cvar and the second brother returned. They asked him to leave again but he refused, police said.

A physical confrontation then ensued between Heidengren and Cvar and his brother who had come with him to the home, authorities said.

The much younger Heidengren was winning the confrontation when John Cvar allegedly pulled out a revolver he had brought with him, authorities said.

He later claimed to police he only wanted to scare Heidengren.  But a shot he fired hit Heidengren in the neck, authorities said. Heidengren ran out of the home and collapsed. He was pronounced dead at the scene.

John Cvar was arrested later the same day and the gun was recovered.
