Man charged in Oakland fistfight related shooting

OAKLAND –A man who was winning a fistfight Oct. 29 before he was jumped and beaten by three of his opponent’s friends, prompting him to get a gun and allegedly shoot the man he had been fighting with, has been charged with attempted murder and carrying a loaded firearm in public, according to authorities and court records.

The suspect, Ricardo Patron, 39,  of Oakland, has pleaded not guilty to the charges and has a pre-trial hearing set for Dec. 8. He is being held without bail at Santa Rita Jail.

The violence, which was captured on video surveillance, happened about 8:38 p.m. Oct. 29 in the 2200 block of 35th Avenue in the Fruitvale district. Patron had gotten into a fistfight for unknown reasons with a 28-year-old man he did not know.

Patron was winning the fight when three friends of the younger man intervened and severely beat him. He went to his nearby home where, according to court records, he got a pistol, came back to the site where the four men were and allegedly shot the younger man, firing several rounds at him as he tried to run away.

The man shot got his own transportation to a hospital and has since been released.

Patron sought medical aid at an Alameda hospital where he claimed he had been attacked in another part of Oakland. Oakland police were alerted and he was arrested at the hospital after Oakland officers realized he matched the description of the suspect in the shooting and was still wearing some of the clothing seen in the video surveillance. He declined to talk to investigators.
