Officers were called to the 100 block of Old Tully Road around 5:40 a.m. Sunday for a report of an unconscious man outside a business, San Jose police Sgt. Jorge Garibay said in a news release. They arrived to find a man who was bleeding and had signs of being assaulted.

He was taken to a hospital to be treated for his injuries, which did not initially appear to be life-threatening.

Garibay said officers identified the primary suspect as Eugene Pickett, 28, of San Jose, and secured a warrant for his arrest.

Pickett was arrested Monday and booked into the Santa Clara County Main Jail on charges including assault with a deadly weapon, robbery and elder abuse, Garibay said.

On Tuesday, police learned the victim had died of his injuries. The Santa Clara County Medical Examiner-Coroner’s Office will release his identity once it is confirmed and his next of kin is notified.

Garibay said detectives obtained a new warrant for murder and served it at the jail, where Pickett was still being held.

The case is being investigated as San Jose’s ninth homicide of the year, Garibay said.
