Temporary restraining order bars ICE from re-detaining Bay Area man

SAN JOSE – A U.S. District Court judge on Monday afternoon issued a temporary retraining order barring Immigration and Customs Enforcement from re-detaining a Bay Area man while the court hears additional arguments regarding the case.

Guillermo Medina Reyes was set to be re-detained Tuesday morning, according to the California Collaborative for Immigrant Justice. The collaborative described Reyes as a “formerly incarcerated individual, local tattoo artist and community organizer.”

The order, issued by U.S. District Judge Rita F. Lin, indicates Reyes was arrested by police in mid-May. But instead of re-detaining Reyes at that time, ICE notified him he would be taken into custody on July 1.

Lin said the federal agency’s “course of conduct demonstrates their lack of urgency,” as does its “request for a more extended briefing and hearing schedule than initially proposed by the court in the event a temporary restraining order was granted.”

The order prohibits ICE from re-arresting and re-detaining Reyes until 5 p.m. on July 14. At 1 p.m. the same day, the federal agency must “show cause” in person at a hearing why a preliminary injunction should not be issued, according to the order.

Reyes has lived in the United States since he was 6 years old. The collaborative said he was released from ICE custody on bond in 2023, after serving a prison sentence.

While in ICE custody at the Golden State Annex, Reyes participated in a labor strike to call for detained immigrants to be paid minimum wage as mandated in California, as well as co-organized a monthlong hunger strike, according to the collaborative.

He also partnered with human rights organizations to call attention to conditions at GSA.

Reyes was set to be re-detained during an ICE check-in Tuesday at 393 Blossom Hill Road in San Jose. The collaborative said he is still required to attend the 8 a.m. meeting.

A rally, which was planned before the order was issued, is still expected to take place.

“With the possibility of being detained again, I can’t even describe how awful it feels,” Reyes said in a statement Monday. “However, I feel so moved to know so many people in my community are coming out to support me and help me stay free.”
