Richmond: Police release videos showing man charging with knife before Aug. 4 shooting

RICHMOND — A Richmond police officer who was one of two who fired a gun in the killing of a man during a domestic disturbance last week also fired his gun in a fatal police shooting in February, police said Monday.

Richmond Police Chief Bisa French also called for more to be done for those struggling with mental illness during a news conference at department headquarters to discuss the Aug. 4 domestic violence call that ended with 27-year-old Angel Montano, of Richmond, dead.

Police also showed video of the moments leading up to the shooting, during which officers clearly can be heard telling Montano to stop his actions and Montano can be seen holding knives in his hands.

Police publicly identified Montano for the first time on Monday. Family members had confirmed his identity and said he was a U.S. Marine. Richmond police on Monday said they have not confirmed whether Montano was on active duty in the military.

In her statement, French said the officers who fired on Montano were Officer Colton Stocking and Officer Nicholas Remick. Department spokesperson Lt. Donald Patchin said both officers were hired out of the police academy and have been working about 2½ years.

Patchin also acknowledged that Remick was one of the shooters who fired a gun in the fatal police shooting of 51-year-old Jose Mendez Rios on Feb. 4. Police, in a statement when it happened, said Mendez Rios charged at them with what they believed to be a knife, but what turned out to be a sheath.

Patchin said Remick had returned to active duty Feb. 20 from that shooting. He and Stocking remain on paid administrative leave pending an investigation by Richmond police and the Contra Costa County District Attorney’s Office into the more recent shooting.

French said Montano’s brother called 911 about 5 p.m. and said Montano was acting aggressively and armed with a knife while threatening to kill him and his mother. Officers initially strategized to await the arrival of less-than-lethal tools and more resources for treating a mental health crisis.

Instead, updates from the dispatcher — in particular the brother’s cries for officers to arrive, Patchin said — forced the officers’ hand.

“We continue to talk about alternative responses,” French said while urging people to listen to the dispatch tapes and watch the videos posted on the city’s website. “But we still leave up to mentally ill individuals to make decisions that they clearly not capable of making, and something has to change. I don’t have the answers for what can be done. I do hope there will be conversation about legislation and laws that get people that need mental help and assistance they need.”

Video displayed at the news conference showed officers start to fire as Montano charges out the door. A blown-up image of the video clearly showed him holding a knife as he comes out the door.

Patchin said that Montano’s actions turned the incident into one that mental health teams could not have handled.

“Once we know he has a weapon in his hands, this situation was not one where they would’ve responded because he is now armed,” Patchin said, adding that mental health or alternative teams “are not equipped to deal with that.”

Police said that Montano came at them from inside the residence within six seconds of officers announcing themselves.

“This is not the ending any of us wanted,” Patchin said.

Patchin said Remick had cleared a succession of protocols to return to active duty after the February shooting of Mendez Rios. The California Department of Justice has taken over that investigation because Mendez Rios did not have a weapon when officers fired.
