Two suspects charged in Emeryville fatal shooting

EMERYVILLE — Two men have been charged with murder and other crimes in the fatal shooting of another man Tuesday morning, according to authorities and court records.

The suspects were identified as Armand Watson, 52, of Oakland, and Isaac Landry, 51, of Rodeo.

In addition to the murder count, Watson is also charged with possession of a firearm by a felon and possession of ammunition by a prohibited person. Landry is also charged with evading an officer.

They are accused in the killing of Robert Abeyta, 43, of Oakland; he was shot about 1:11 a.m. Tuesday in the 3800 block of San Pablo Avenue. The incident was captured on area surveillance video.

According to court documents, Watson and Abeyta were arguing in front of a market when a Honda Accord driven by Landry pulled up. Watson moved to enter the vehicle, while Landry got out and began arguing with Abeyta.

Police said the suspects did not know Abeyta but have not specified what the argument may have been about.

The documents say Watson got a firearm from the vehicle and began shooting at Abeyta. A physical struggle then ensued, during which Landry allegedly stomped Abeyta in the head several times as he lay on the pavement, leaving him unconscious, the documents say. He was taken to a hospital where he later died.

The two men fled in the Honda but were arrested within minutes — after crashing into into a center median — by UC police, who were in the area.

The killing was the first homicide investigated by Emeryville police this year.

According to court documents, Landry has four prior felony convictions between June of 1993 and October of 2009 in Alameda and Contra Costa counties. The 1993 conviction in Alameda County was for second degree robbery and the 2009 conviction in Alameda County was for felon in possession of a firearm. He was sent to prison after both convictions.

According to the documents, Watson has two prior felony convictions in Louisiana in 1995 and 1997 for possession of cocaine and possession of a firearm by a felon.
