Ex-Emeryville school security guard pleads no contest to statutory rape of student

OAKLAND — A former security guard at Emery High School was sentenced to probation and ordered to do 200 hours of community service after pleading no contest to statutory rape of a then-16-year-old girl, court records show.

Daniel Parham, 23, pleaded no contest to a single count of felony unlawful sexual intercourse, and prosecutors dropped two sex abuse charges as part of the deal, records show. He was formally sentenced to 12 days that he’d already served in jail as well as the probation and community service terms.

Parham was not required to register as a sex offender, but he was ordered to undergo 16 hours of therapy to address “respect and age issues with women,” according to court records. He has also been ordered to stay away from schools.

Parham was 21 at the time of his arrest. The girl’s family has filed a still-active lawsuit against the Emeryville Unified School District, alleging officials missed signs that Parham was violating school policy and that he “groped” multiple students.

Parham’s lawyer, Colin Cooper, called the plea deal a win for the defense. He said the girl accused Parham of rape several times, but text messages given to the defense disproved forcible sexual assault.

“It’s about the least serious sex charge one could have,” Cooper said.

District officials have filed court papers citing testimony that the school’s principal immediately called police and Child Protective Services upon learning the girl accused Parham of sexual abuse on Nov. 9, 2023. That was the same day she disclosed it to her parents, according to court filings.

In late 2023, police documented at least four acts of alleged sexual abuse, all of which allegedly occurred on school property. The girl came forward about a week after one of the incidents, which happened inside the girl’s locker room, according to court filings.
